Overview
These Terms of Service ("Terms") govern your access to and use of www.hillhallhotelc.om and any related websites, booking pages, forms, or digital services operated by Hill Hall Hotel, LLC, doing business as Hill Hall Hotel. By accessing or using the Site, you agree to these Terms.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation.
- Interfere with or disrupt the Site or any related servers or networks.
- Attempt to gain unauthorized access to any part of the Site or related systems.
- Copy, scrape, reproduce, distribute, or exploit Site content except as permitted by law or with our prior written consent.
2. Reservations and Inquiries
Reservations, dining reservations, event inquiries, and other submissions made through the Site are subject to availability, confirmation, and any additional terms, cancellation policies, deposits, event agreements, or booking conditions presented at the time of booking or inquiry. We reserve the right to refuse, limit, or cancel reservations or requests where reasonably necessary, including in cases of suspected fraud, error, misuse, violation of these Terms, or unavailability.
3. Third-Party Booking Platforms
The Site may direct you to third-party booking or payment platforms, including Design Hotels, Marriott-affiliated systems, or other reservation technology providers, as applicable. Transactions completed through those platforms may also be subject to separate terms, conditions, and privacy policies maintained by those providers.
4. Payments
If payments are accepted through the Site or through linked reservation technology, they will generally be processed by third-party providers. You agree to provide current, complete, and accurate payment and billing information for any transaction.
5. Intellectual Property
The Site, including its text, photographs, graphics, logos, design elements, audio, video, code, and overall presentation, is owned by or licensed to us and is protected by intellectual property and other applicable laws. Except for limited personal, non-commercial use, no content from the Site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed without our prior written consent.
6. Guest Conduct and Property Rights
Use of the Site does not guarantee accommodation, dining access, event access, or any other service. We reserve the right, to the fullest extent permitted by law and subject to any applicable reservation or guest agreement, to refuse service, cancel reservations, or remove guests or visitors for conduct that is unlawful, abusive, disruptive, fraudulent, or poses a risk to staff, guests, neighbors, or property.
7. Event and Group Bookings
Event bookings, weddings, retreats, and group reservations may be subject to separate written agreements that govern pricing, payment schedules, room blocks, attrition, cancellation rights, force majeure, and related terms. In the event of a conflict between these Terms and a separate written event or group agreement, the separate agreement will control for that transaction.
8. Site Content and Availability
We strive to keep information on the Site accurate and current, but we do not guarantee that the Site or any content is complete, accurate, or up to date at all times. We may modify, suspend, or discontinue any aspect of the Site at any time without notice.
9. Disclaimer of Warranties
To the fullest extent permitted by law, the Site is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Hill Hall and its affiliates, owners, managers, officers, employees, agents, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages.
11. Indemnification
You agree to defend, indemnify, and hold harmless Hill Hall and its affiliates, owners, managers, officers, employees, agents, and service providers from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses arising out of or related to your violation of these Terms or misuse of the Site.
12. Privacy
Your use of the Site is also subject to our Privacy Policy and Cookie Settings and Cookie Policy.
13. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-laws principles. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in West Virginia, and you consent to that jurisdiction and venue, except where applicable law provides otherwise.
14. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a revised Effective Date. Your continued use of the Site after any changes become effective constitutes your acceptance of the revised Terms.
